1 Overview

i. This policy forms part of Our overall Terms of Service.

ii. We value Your privacy, and We commit to the protection of and will endeavour to protect Your privacy. By continuing to use the Site or Facility You signify that You accept Our Privacy Policy and that You consent to Our usage of Your Personal Information in accordance with the terms of this Policy.

2  Personal Information collected by Us about You

i. When You visit the Site or use the Facility, We may automatically collect certain information about Your electronic device, including but not limited to information about Your web browser, IP address, geographical location, and some of the cookies that are installed on Your device. Additionally, as You browse the Site or use the Facility, We may collect information about the individual web pages that You view, what websites or search terms referred You to the Site or Facility, and information about how You interact with the Site or Facility.

ii. We refer to this automatically-collected information as “Device Information”. We collect Device Information using the following technologies :

When We ask You to provide Personal Information, We will state where this information is required (for example, verification of Your age and eligibility to purchase alcohol), and/or where this information is voluntary; and with the consequences in case You decline to provide any voluntary Personal Information (for example, We may be unable to accept a Booking from You.)

3  Our use of Your Personal Information

i. We may use Your Personal Information as follows :

  • With Your consent, for example when You consent to Our use of cookies in accordance with Our Cookie Policy in section 9 below, or when You consent to receive marketing materials from Us.
  • To discharge Our contractual obligations to You in fulfilment of or to service any Booking or purchase that You place with Us through the Site; including but not limited to processing Your payment information, processing and maintaining Your account information, arranging for shipping, and providing You with invoices, order confirmations, and other communications relating to Your order.
  • In case We are required so to do by any law or by competent authority.

ii. We use the Device Information that We collect from You to help Us screen for potential risk and fraud (in particular, Your IP address), and more generally to improve and optimize the Site or Facility (for example, by generating analytics about how Our customers browse and interact with the Site or Facility, and to assess the success of Our marketing and advertising campaigns).

iii. We may use Device Information that We collect from You in the form of cookies to target advertising as You browse the Web. You can opt out of this in accordance with Our Cookie Policy in section 9 below.

4  Sharing of Your Personal Information

i. We may share Your Personal Information with Our payment service provider, with Our Booking system provider and with any subcontractors, affiliates or agents which We may use in fulfilment of or in service of any order made by You on the Site.

iii. We may share Your Personal Information with Hunter Laing & Company Ltd. and their subsidiary or affiliated companies, and with Our other trusted strategic partners (including for the detection of and prevention of fraudulent transactions). We may also share Your Personal Information as may be necessary in the event that We transfer, sell or otherwise dispose of a portion of or all of Our business or Our assets.

iv. We may share Your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information We receive, or to otherwise protect Our rights.

v. In the event that Your personal data is shared to a country different to that where You reside and to where We operate, then We will apply as a minimum the data protection standards which are used in the EEA.

vi. The Site may offer links to and/or plugins for third party social media and networked content. If You access these features on the Site then Your Device Data may be shared to or shared by these third parties. These third party features have data & privacy policies which are not under Our control and We take no responsibility for any aspect of these policies. You accept that You may or may not be satisfied with the data & privacy policies of any third party social media organisation or feature, and that You have responsibility for managing Your interaction with these third parties.

5  Your rights

i. You have a right to ask Us for a copy of Personal Information which We may hold about You. You can ask Us to update, correct or delete Your Personal Information.

ii. You have a right to withdraw consent which You have given to Our processing of Your Personal Information.

iii. You have a right to object to Our processing of Your data for Our legitimate purposes as described in this Policy. This right may be limited in the event that We demonstrate a legal or other requirement incumbent upon Us for the processing of Your Personal Information. This right may also have consequences for Your usage of the Site, for example if You object to Our processing of Your Personal Information then We may decline to accept any Booking that You may wish to place on the Site.

iv. If You wish to make any notification to Us about Your rights, then please do so via the contact details in section 7 below. In case of any query or complaint which You may have about data processing & privacy then You may also contact the relevant statutory authorities; We ask that You would contact Us in the first instance so that We may attempt to address Your concern.

6  Data retention

i. We will retain Your Personal Information for the period in which We require to process it in order to service the objectives described in this Policy (for example to fulfil an order which You have made on the Site).

ii. We may also retain Your Personal Information for a period beyond that of any particular order or transaction which You may make with Us, for example to enable Us to service any legal or contractual obligation which We may have separate to any interaction with You. We will keep this retention under review.

iii. We will delete Your Personal Information when You ask Us to, unless We demonstrate a legal or other requirement incumbent upon Us for the retention of Your Personal Information.

7  Minors

i. This Site is not intended for use by anyone who is under the age at which they may legally buy alcohol in their local jurisdiction.

9  Cookies Policy

i. A cookie is a small piece of information which is stored on Your electronic device when You access a website. Cookies from a website may be set by that website itself, or may come from a third party such as an advertiser or internet content provider. ii. The Site uses cookies. These fall into two main categories :

  • Cookies required for the basic functioning of the Site; for example to remember in Your web browser Your age details, details of Bookings you have made, and so on.
  • Cookies used for targeting content, reporting and analytics; for example to support Our site traffic analysis, or to enable Us or a third party to better target advertising to You.

iii. The cookies which the Site uses are provided by Checkfront who are Our Booking system service provider. The cookies are as follows :
